ORDER

The present criminal original petition has been filed to modify the condition imposed on the petitioner in Crl.M.P.No.2013 of 2016 in Crime No.1078 of 2016 dated 16.12.2016 on the file of the learned Principal Sessions Judge at Dharmapuri.

2. It is the case of the petitioner that in connection with a case in Crime No.1078 of 2016, he was arrested on 6.12.2016. Immediately, he moved a bail petition before the learned Principal Sessions Judge at Dharmapuri in Cr.M.P.No.2013 of 2016 and the learned Judge, granted bail to the petitioner by imposing certain conditions. One of the conditions is that the petitioner should deposit a sum of Rs.50,000/- before the learned Judicial Magistrate, Pennagaram. Since the petitioner is very poor, he is unable to deposit the said amount. In view of the same, the petitioner is not in a position to avail the benefit of the said order. Hence, seeking modification of the said order, the petitioner has come up with the present petition.

3. Learned Additional Public Prosecutor has no serious objection to modify the said condition imposed on the petitioner.

4. Considering the facts and circumstances of the case, this Court is inclined to permit the petitioner to deposit a sum of Rs.25,000/- instead of Rs.50,000/-. Accordingly, the petitioner is permitted to deposit a sum of Rs.25,000/- (Rupees twenty five thousand only) instead of Rs.50,000/- as per the bail condition imposed on him in Crl.M.P.No.2013 of 2016 dated 16.12.2016, by the learned Principal Sessions Judge at Dharmapuri. The other conditions shall remain unaltered. The criminal original petition is ordered accordingly. Sd/- Asst.Registrar (CS V ) /true copy/ Sub Asst.
