PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a writ of Mandamus to direct the respondents to sanction and reimburse the medical expenses of Rs.1,44,816/- for treatment undergone by the petitioner's husband within a time frame fixed by this Court. ORDER
The present writ petition has been filed with a prayer for mandamus to direct the respondents to sanction and reimburse the medical expenses of Rs.1,44,816/- for treatment undergone by the petitioner's husband within a reasonable time.
2. The learned counsel for the petitioner submits that the petitioner is a retired employee who availed medical treatment for her husband, incurring an expense of Rs.1,44,000/-. She applied for reimbursement of the said amount, but her request has not yet been considered by the respondents. In this regard, she submitted a representation to the 2nd respondent on 28.11.2024. However, the typed set of papers filed along with the writ petition does not contain any 2/6
proof of service of the said representation to the 2nd respondent.

However, while examining the typed set of papers, it is noted that the 3rd respondent, Director of Treasury, had addressed a letter to the 4th respondent, District Officer, namely the 4th respondent, requesting a report from the District Level Empowered Committee (DLEC) for processing the petitioner's claim along with those of other claimants. Therefore, though there is no proof of service of the petitioner's representation to the 2nd respondent, the contents of the 3rd respondent's letter to the 4th respondent clearly indicate that the petitioner's claim is under consideration, and the disbursement is delayed only on account of awaiting report from the District Level Empowered Committee (DLEC).

In view of the above, this Court deems it appropriate to direct the District Level Empowered Committee (DLEC) to furnish the required report to the District Treasury Officer, Thanjavur in pursuance of the 3rd respondent's letter dated 18.06.2025, within a period of four (4) weeks from the date of receipt of a copy of this order.

5. With the above observations, the writ petition stands disposed of. No costs.
