PRAYER : Criminal Original Petition has been filed under Section 482 of Criminal Procedure Code, to direct the respondent to do further investigation and file charge sheet afresh in C.C. No.66 of 2020 on the file of the Court of the Subordinate Court (Assistant Sessions Judge), Gingee relating to the Crime No.126/2019 on the file of the respondent within a period to be stipulated by this Court.

ORDER

This petition is filed for further investigation, in a case registered in the year 2019 and charge sheeted in the year 2020. A sequence of dispute between members of two parties in the polling booth leading to attempt to murder. A case in Crime No.126 of 2019, on the file of the Valathy Police Station, Villupuram District came to be registered and on completion of investigation, final report filed and the same was taken on file in S.C. No.60 of 2020 made out to the learned Additional Sessions Court, Gingee, Villupuram.

2. The defacto complainant after a lapse of four years after an incident, has now sought for intervention of this Court alleging that the Investigation Officer has not collected enough evidence and statements of witnesses will speak about the incident. Therefore further investigation is required.

3. The petitioner being the defacto complainant who has set the law into motion been following the case and the present petition for further investigation filed after lapse of several years when the trial is about to be commenced. This Court finds no reason to entertain this petition since final report and Section Page No.2/4

161 of Cr.P.C statements has complete narration of the incident and the evidences available. Hence, this Criminal Original Petition is dismissed. Consequently, connected Miscellaneous Petition is also dismissed. 12.10.2023 Index : Yes/No rkp To
