A.No.4268 of 2021 is filed to set aside the abatement on account of the death of the 3rd defendant.

2.A.No.4269 of 2021 is filed to bring on record the respondents 7 to 9 herein as defendants 8 to 10 in the above suit, they being the legal heirs of the 3rd defendant P.L.Deepakh (since deceased). 3.A.No.4270 of 2021 is filed to appoint the 7th respondent/proposed 8th defendant as the guardian and next friend of the respondent 8 and 9 / proposed defendants 9 and 10 viz. Minor D.Rithwik and Minor D.Kashika. 4.The proposed 8th defendant is a widow of the deceased 3rd defendant and the proposed defendants 9 and 10 are his children, they are minors. Notice served. Their names appear in the cause list. 5.Since the defendants 9 and 10 are minors, this Court appoints Mrs.Vasudha Thiagarajan as a Court Guardian for the defendants 9 and 10 in the suit.

6.All these applications are allowed.

kas 7.Learned counsel for the plaintiff is now required to take suit summons on the 8th defendant and also serve a copy of the plaint on Mrs.Vasudha Thiagarajan.

8.Registry is now required to print the name of Mrs.Vasudha Thiagarajan as Court Guardian for the defendants 9 and 10.

9.Though the plaintiff has to carry out amendment, in view of the ongoing COVID restrictions in holding the physical Court but at the same time to ensure that unnecessary time is not lost for carrying out amendment, this Court now requires the Registry to carry out necessary amendment in the plaint.
