The wife and minor daughter of R.Karunakaran, who died intestate on 06.05.2021 have approached this Court under Section 372 of the Indian Succession Act 1925, seeking Succession Certificate with respect to the securities held by R.Karunakaran at Kotak Mahindra Bank and LIC Insurance.
2. In the proof affidavit and in the petition, it had been very specifically stated that the parents of R.Karunakaran predeceased him. It had also been specifically stated that apart from the petitioners, there are no other class - I legal heir surviving him. After publication had been effected, the petitioners were invited to adduce evidence. The first petitioner herself examined as PW-1. The death certificate of R.Karunakaran was marked as Ex.P-1, the legal heirship certificate was marked as Ex.P-2, Exs. P-3 and P-4 are documents relating to Kotak Mahindra Bank and LIC Insurance. In the legal heirship certificate Ex.P-2, it had been very specifically mentioned that the mother of Karunakaran, R.Vellathai had predeceased him.

In view these facts, this Petition stands allowed as prayed for and a direction for grant of Succession Certificate to the first petitioner with power to collect the debts and to receive the interest more specifically mentioned in the schedule is issued.
