Respondent Prayer: Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus or any other appropriate Writ, order or Direction directing the respondent to pass a regular/normal retirement order to the petitioner by implementing the notional promotion granted on 22.05.2017 to the petitioner as Assistant Executive Engineer and to revoke the earlier conditional retirement order dated 30.06.2016 and consequently release all the terminal and Pensionary benefits to the petitioner by considering his representation dated 25.07.2019 and to pass further or other appropriate orders. The case of the petitioner is that the petitioner is a retired employee and petitioner was sanctioned a provisional pension of Rs.16,745/-. Though the petitioner was granted notional promotion, since the order of conditional retirement passed on him is still in force and the regular retirement order is not passed, till date he is unable to receive retirement https://hcservices.ecourts.gov.in/hcservices/

benefits.

For which, the petitioner sent several representations to the respondent requesting to revoke the earlier conditional retirement order and pass fresh regular retirement order but till date no action was taken on the issue, hence the present Writ Petition is filed.

2. The learned counsel for the petitioner would submit that it would be suffice if a direction is issued to the respondent to dispose of the final representation dated 25.07.2019 filed by the petitioner on and pass order on merits and in accordance with law, within a stipulated time.

3. Without expressing any opinion on the merits of the case and considering the limited request made by the learned counsel for the petitioner, I am inclined to issue direction to the respondent to dispose of the representation made by the petitioner on 25.07.2019 on merits and in accordance with law within a period of twelve (12) weeks from the date of receipt of a copy of this order. With the above direction, the Writ Petition is disposed of. No costs.
