PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C. to direct the respondent Nos.1 & 2 herein to provide adequate police protection to revenue officials while carry out the survey the Natham Land bearing Survey Nos.89/1B1 measuring about 0.11.0 Ares situated at Ma.Podayur Village, Thittakudi Taluk, Cuddalore District by considering the representation of the petitioner dated 23.11.2021 in accordance with law. O R D E R
This Criminal Original Petition has been filed to direct the respondent Nos.1 & 2 herein to provide adequate police protection to revenue officials while carry out the survey the Natham Land bearing Survey Nos.89/1B1 measuring about 0.11.0 Ares situated at Ma.Podayur Village, Thittakudi Taluk, Cuddalore District by considering the representation of the petitioner dated 23.11.2021 in accordance with law.
2.The contention of the petitioner is that the petitioner wanted to survey the natham land comprised in Survey No.89/1B1 situated at Ma.Podayur Village, Thittakudi Taluk, Cuddalore District. For which he had paid the requisite fee by way of a challan on 13.10.2021. Thereafter, the Tahsildar, Thittakudi had sent the Revenue Officials and the Surveyor to survey the land and to mark boundaries. At that time, the petitioner's neighbours viz., Pachaiyammal, Lakshmi, Narayanasamy, Chitra and Amudan have objected to the same and threatened the Revenue Officials. Thereafter the Revenue Officials have withdrawn and the survey could not be conducted. Hence, he had sent a representation to the Superintendent of Police, Cuddalore as well as the Inspector of Police, Ramanatham Police Station on 23.11.2021. Thereafter, no action has been taken. Hence he filed this petition.
3.The learned Government Advocate [Crl. Side] submits that the petitioner had sent a representation to the respondent Nos.1 and 2 by post on 23.11.2021. Further he requested this Court to issue a direction to the petitioner to appear before the respondent police in person along with the copy of the representation dated 23.11.2021 and also the necessary documents available, so that the respondent police can verify the same with the Revenue Officials. Thereafter, on the request made by the public servants, the respondent police can provide protection to carry on their official functioning without any obstruction.
4.In view of the same, the petitioner is directed to appear before the respondent police, submit the copy of the representation dated 23.11.2021, along with the challan, patta copy and any other documents in his possession. Thereafter, the respondent police are directed to co-ordinate with the Tahsildar, Thittakudi as well as the Surveyor from the Survey Department, fix a date and see to that the survey of the land is carried out without any hindrance.
5.With the above direction, this Criminal Original Petition is disposed of.
