The petitioner, who was arrested on 26.09.2024, for the offence punishable under Sections 62, 305(a) and 331(4) of BNS Act, 2023 in connection with Crime No. 469 of 2024, registered on the file of the respondent, seeks bail. 1/4

2. The case of the prosecution is that the petitioner along with coaccused alleged to have lurked into the house of the defacto complainant in an attempt to commit theft.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and has not committed any offence as alleged by the prosecution. It is further submitted that the petitioner was not named in the original complaint, but the respondent police has falsely implicated him in the case. The learned counsel also contended that the police have not conducted a proper investigation and have arrayed the petitioner in this case because they have failed to apprehend the actual culprits in similar theft cases. It was also argued that a Goondas Act detention was imposed on the petitioner, which was subsequently set aside by this Hon'ble Court in HCP No. 2822 of 2024 by order dated 03.06.2025. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Criminal Side) appearing for the respondent submitted that the investigation is at a crucial stage and custodial interrogation of the petitioner is necessary to trace the involvement of the 2/4

petitioner and other possible accused in the chain of thefts that took place in the locality. He further submitted that if the petitioner is released on bail at this stage, it may hamper the ongoing investigation and there is a likelihood of tampering with witnesses or absconding.

5. Heard both sides and perused the materials available on record.

6. Considering the gravity of the offence, the stage of investigation and the possibility of the petitioner interfering with the investigation if enlarged on bail, this Court is not inclined to grant bail to the petitioner at this stage.
