Prayer :- Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the first respondent to measure the vacant land measuring to an extent of 1750 sq.ft. equal to 162.63 sq.mtr. comprised in survey No.339/17B situated at Roadmamanthal Village, Siruvangur Madura Roadmamandhal Village in Kallakurichi Taluk & District and consequently direct the second respondent to provide adequate police protection to measure the property by considering the petitioner representation dated 11.08.2021 within a time to be fixed by this Court.

ORDER

This writ petition is filed to issue a Writ of Mandamus directing the first respondent to measure the vacant land measuring to an extent of 1750 sq.ft. equal to 162.63 sq.mtr. comprised in survey No.339/17B situated at Roadmamanthal Village, Siruvangur Madura Roadmamandhal Village in Kallakurichi Taluk & District and consequently direct the second respondent to provide adequate police protection to measure the property by considering the petitioner representation dated 11.08.2021 within a time to be fixed by this Court.

2. Heard, Mr.A.V.Raja, the learned counsel for the petitioner, and Mr.A.M.Ayyadurai, Government Advocate appearing for the respondents.

3. The petitioner submitted representation to measure the vacant land and for police protection, which is pending. Therefore, the first respondent is directed to consider the representation of the petitioner dated 11.08.2021 and conduct enquiry after issuance of notice to the adjacent land owners and counter parties, if any, and, after giving them opportunity of hearing, pass orders to measure the vacant land measuring to an extent of 1750 sq.ft. equal to 162.63 sq.mtr. comprised in survey No.339/17B situated at Roadmamanthal Village, Siruvangur Madura Roadmamandhal Village in Kallakurichi Taluk & District and to direct the second respondent to provide adequate police protection to measure the property, on merits and in accordance with law, within a period of twelve weeks from the date of receipt of copy of this order, on payment of requisite fees.

4. With the above direction, this writ petition is disposed of. No order as to costs.
