Writ Petition is filed under Article 226 of the Constitution of India, seeking issuance of Writ of Mandamus, forbearing the second and third respondents from interfering with the peaceful possession and enjoyment of the properties/houses situated in T.S.No.171&172 in Block No.31 bearing Door Nos.8 and 8/1, New Nos.21 and 21/8, Thiruvenkadams Street, Vetri Nagar, Chennai, barring 400 sq. feet out of 2598 sq.feet in accordance with the decree and as directed by this Hon'ble Court in S.A.No.621 of 2024 vide judgment dated 20.06.2024 and further direct the first respondent to initiate criminal and departmental proceedings against the respondents 2 to 4. ORDER

Writ Petition has been filed seeking a direction to forbear the second and third respondents from interfering with the peaceful possession and enjoyment of the properties/houses situated in T.S.No.171&172 in Block No.31 bearing Door Nos.8 and 8/1, New Nos.21 and 21/8, Thiruvenkadams Street, Vetri Nagar, Chennai, barring 400 sq. feet out of 2598 sq.feet in accordance with the decree and as directed by this Hon'ble Court in S.A.No.621 of 2024 vide judgment dated 20.06.2024 and further direct the first respondent to initiate criminal and departmental proceedings against the respondents 2 to 4.

2. Learned counsel for the petitioners submitted that the prayer sought for by the petitioners in this writ petition has become infructuous. However, this Court vide order dated 12.9.2024, directed the respondent-Police to take action against the private respondents 5 and 6 and also against the officials who had been in connivance with the private respondents to take forceful possession from the petitioners and to file a action taken report on the complaint given by the petitioners herein. But no report has been filed so far. 3/6

3. Learned Government Advocate (Crl.Side) appearing for the respondents-Police submitted that Crime No.461 and 462 of 2024 have been registered as against the private respondents. He further submitted that pending investigation, F.I.R in Crime Nos. 461 and 462 of 2024 have been transferred to the Inspector of Police, Vyasarpadi Police Station for further investigation.

4. Learned counsel for the private respondents submitted that the private respondents have obtained anticipatory bail.

5. In such view of the matter, this Court directs the second respondent to monitor the investigation and direct the concerned Police to complete the investigation and file a final report before the concerned Court at the earliest.

6. With the abovesaid direction, this Writ Petition is closed. No costs. Consequently, connected miscellaneous petition is also closed. 01.09.2025 Speaking Order :Yes/No Index :Yes/No mfa 4/6
