A. No.4371 of 2021 has been filed seeking for transfer of the suit in O.S. No.4767 of 2019 pending on the file of I Additional City Civil Court to this Court.

2. The plaintiff has filed the present suit seeking for specific performance of an agreement of sale. The defendants / respondents 1 to 6 have earlier filed the suit before the City Civil Court seeking for declaration to declare the agreement of sale entered into between the plaintiff and the defendants 1 to 6 as null and void . Since both the suits pertain to the same property, this application has been filed seeking for transfer of the suit from the file of City Civil Court, Chennai to this Court.

3. Heard Mr.S. Praveen Kumar, learned counsel for the respondents / defendants in this suit.

4. The learned counsel for the respondents / defendants in this suit and the respondents in the application filed by the plaintiff seeking for 1/3

transfer has stated no objection for transfer of the suit pending on the file of the City Civil Court to this Court. The said statement is recorded.

5. After recording no objection stated by the learned counsel for the respondents / defendants, this Court is inclined to allow the application filed by the applicant / plaintiff seeking for transfer of the suit pending on the file of the I Additional City Civil Court to the file of this Court as both the suits will have to be heard together. Accordingly, A. No.4371 of 2021 is allowed as prayed for.

Consequently A. No.4372 of 2021 is closed.
