The petitioner, who was arrested and remanded to judicial custody on 11.07.2022 for the offences punishable under Sections 341, 294(b), 392, 397 & 506(ii) of IPC, in Crime No.370 of 2022, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner waylaid the de-facto complainant and abused him in a filthy language and by threatening him at knife point robbed a sum of Rs.350/- from him. Hence the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays for grant of bail to the petitioner. 1/4

4. The learned Government Advocate (Crl.Side) would submit that the petitioner is a habitual offender and there are nine previous cases against him. Hence, he vehemently opposed to grant bail to the petitioner.

6. Heard both the learned Counsel and perused the materials available on record.

Taking into consideration the facts and circumstances of the case, the submissions made by the learned counsel and that the petitioner has got 9 previous cases against him and the petitioner is a habitual offender and also the fact that very recently on 09.09.2022, this Court had dismissed the application for bail and there is no change of circumstances, this Court is not inclined to grant bail to the petitioner.

8. Accordingly, this Criminal Original Petition stands dismissed for the present.
