Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify the condition "(c) after coming out on bail, within a period of four weeks therefrom, the petitioners shall jointly deposit the balance sum of Rs.50,00,000/- at the rate of Rs.25,00,000/- each in the two accounts, viz., GSTIN-33AQSPG9533A1ZX and GSTIN33ABDCS4905P1Z1 respectively, and produce proof of such deposit before the learned Magistrate, and permit the petitioner to withdraw the money lying in the bank accounts freeze by the respondent and make transfer/deposit as directed and for the balance sum time may be extended by twelve weeks and pass any other order which the Hon'ble court. [IN ALL THE PETITIONS]
Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.B.MANOHARAN, Advocate for the Petitioners [IN ALL THE PETITIONS] and of M/S.N.P.KUMAR, Special Public Prosecutor on behalf of the Respondent [IN ALL THE PETITIONS] the court made the following order:- The petitioners have filed these petitions seeking to modify the conditional amount imposed in the order dated 01.11.2021 made in Crl.O.P.Nos.20023, 20021 and 20019 of 2021.
2.Heard both sides.
3.The learned counsel appearing for the petitioners submitted that the amount imposed by this Court is exorbitant and the petitioners are not in a position to pay the amount and prayed to modify the condition.
4.The order dated 01.11.2021 was passed based on the affidavit filed by the petitioners and contrary to the affidavit, the petitioners have filed these petitions seeking modification in the conditional amount which is not sustainable.
5.At this juncture, the learned counsel appearing for the petitioners seek to grant further time to comply with the order dated 01.11.2021 made in Crl.O.P.Nos.20023, 20021 and 20019 of 2021. 6.This petition is dismissed. However, considering the request made by the learned counsel appearing for the petitioners, time granted by this Court in the order dated 01.11.2021 made in Crl.O.P.Nos.20023, 20021 and 20019 of 2021 is further extended by a period of two weeks from the date of receipt of a copy of this order. -sd/- 30/11/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
