in Crl. O.P. No.16611 of 2024 P. DHANABAL.J., This petition has been filed to modify the condition imposed by this Court in its order dated 15.07.2024 made in Crl. O.P. No.16611 of 2024 that "the petitioners shall deposit a sum of Rs.2,00,000/- jointly to the credit of Cr. No.193 of 2024 before the learned Magistrate concerned, within a period of two weeks from the date of receipt of a copy of the said order, failing which the interim anticipatory bail granted to the petitioners will automatically stands cancelled".

The learned counsel appearing for the petitioners would contend that already this Court granted interim anticipatory bail to the petitioners on condition that the petitioners have to deposit a sum of Rs.2 lakhs jointly to the credit of Cr. No.193 of 2024 before the learned Magistrate concerned within a period of 2 weeks, but due to their financial condition, they were unable to mobilize the funds and therefore, they sought for modification.

3. The learned Government Advocate (Criminal Side) appearing for the respondent police has objected for the modification of condition by stating that already an interim anticipatory bail was granted to the

petitioners on the condition to deposit a sum of Rs.2 lakhs, failing which the interim anticipatory bail granted to the petitioners will automatically stands cancelled and the petitioners have not complied with the condition imposed on them for the grant of anticipatory bail and have not deposited the amount. Therefore, he opposed for the modification of condition.

4. Heard both sides and perused the records.

Considering the representations made by both sides, considering the fact that already this Court has granted interim anticipatory bail to the petitioners on condition to deposit a sum of Rs.2 lakhs and considering the nature of offences, I am declined to modify the condition. However, time is extended to comply the condition and produce the sureties for a period of one month.

6. Accordingly, this petition is dismissed. The petitioner shall comply with the condition to deposit a sum of Rs.2 lakhs before the learned magistrate concerned, as imposed in the order passed in Crl. O.P. No.16611 of 2024 dated 15.07.2024 and produce the sureties within a period of one month.
