ORDER

The present criminal original petition has been filed to relax the condition imposed on the petitioner in C.M.P.No.754 of 2016 dated 1.8.2016 on the file of the learned Judicial Magistrate, Vanur, Villupuram District.

2. It is the case of the petitioner that in connection with a case in Crime No.451 of 2016, he was arrested and he moved a bail petition in C.M.P.No.681 of 2016 before the learned Judicial Magistrate, Vanur, Villupuram District, and the learned Magistrate, by order dated 13.7.2016, granted bail to the petitioner on certain conditions. One of the conditions is that he shall appear before the respondent police daily at 10.10 a.m. and 5.00 p.m. Subsequently, the petitioner filed a petition in C.M.P.No.754 of 2016 to relax the said condition and the learned Magistrate by order dated 1.8.2016, modified the said condition by ordering the petitioner to appear before the respondent police on the first day of every month till he receives summons https://hcservices.ecourts.gov.in/hcservices/

for appearance in the said case. Now, the petitioner learnt that the respondent police has filed the charge sheet on 1.11.2016. Hence, he filed the present petition to relax the said condition.

3. Learned Additional Public Prosecutor has no objection to relax the said condition.

4. Considering the facts and circumstances of the case, the condition imposed on the petitioner in C.M.P.No.754 of 2016 dated 1.8.2016 is modified to the effect that the petitioner shall appear before the concerned court as and when required.
