O R D E R

This Criminal Original petition has been filed to modify the condition that the petitioner shall deposit a sum of Rs.5,00,000/- (Rupees Five Lakhs only) to the credit of Cr.No.201 of 2019 on the file of the Principal Sessions Judge, Chennai.

2. The case of the prosecution is that the petitioner along with other accused obtained vehicle loan by producing bogus Registration Certificate for huge amount of Rs.14,70,000/-. Hence, a case was registered in Crime No.201 of 2019 for the offences punishable under Sections 120-B r/w 420, 465, 467, 468, 471 of IPC.

3. The learned counsel for the petitioner submitted that https://hcservices.ecourts.gov.in/hcservices/

while granting bail to the petitioner, the trial Court imposed a condition that the petitioner is directed to deposit a sum of Rs.5,00,000/- (Rupees Five Lakhs only) to the credit of Cr.No.201 of 2019 on the file of Principal Sessions Judge, Chennai and the final order in respect of the amount will be passed at the end of the criminal proceedings by the trial court. However, he is unable to mobilize the funds to deposit the amount. Hence, the modification petition has been filed by the petitioner.

4.Per contra, the learned Government Advocate (Criminal Side) would submit that the petitioner has committed very serious offence and hence the learned Sessions Judge has rightly imposed the above said condition.

5. Considering the facts and circumstances of the case, reason is justifiable, hence, this Court modifies the condition that the petitioner shall deposit a sum of Rs.2,00,000/- (Rupees Two Lakhs only) to the credit of Crime No.201 of 2019 before the learned Principal Sessions Judge, Chennai. The other conditions imposed by the Court shall remain intact.

6. With the above modification, this Criminal Original Petition is disposed of.
