ORDER
This Criminal Original Petition has been filed seeking a direction to the learned Special Metropolitan Magistrate (Land Grabbing) Periyamedu, Chennai -3 to dispose of the petition in CMP.No.84 of 2016 in the manner known to law. 2.It is the case of the petitioner that not satisfying with the final report filed by the Inspector of Police, Central Crime Branch, Team-XVI, Vepery, Chennai to the effect that the complaint filed by the petitioner was closed as "mistake of fact" vide RCS No.158/2015 dated 11.07.2015, she filed a protest petition in CMP.No.84 of 2016 before the Special Metropolitan Magistrate (Land Grabbing), Chennai-3 and the same is pending without any progress. Hence, this Criminal Original Petition.
3.When the matter was taken up for consideration, learned counsel for the petitioner submitted that now the Special Court is constituted for trying CCB/CBCID cases at Allikulam, Chennai. https://hcservices.ecourts.gov.in/hcservices/
Therefore, learned counsel prayed to this Court to transfer the petition in CMP.No.84 of 2016 pending on the file of the Special Metropolitan Magistrate (Land Grabbing), Periyamedu, Chennai-3 to the file of the aforesaid Special Court, which is the jurisdictional court.
4.In view of the submission so made by the learned counsel for the petitioner, this Court deems it appropriate to transfer the petition in CMP.No.84 of 2016 to the Special Court constituted for trying CCB/CBCID cases.
5.Accordingly, this petition is disposed of by transferring the petition in CMP.No.84 of 2016 from the file of the learned Special Metropolitan Magistrate (Land Grabbing) Periyamedu, Chennai to the Special Court for CCB/CBCID, Allikulam, who shall take up the petition and proceed further in accordance with law.
