O R D E R

The petitioner is the Defacto complainant in Crime No.19 of 2019 on the file of Nellikuppam Police Station. The case after investigation has been committed to I Additional Sessions Court, Cuddalore and taken on file as SC No.114 of 2021. However, till date trial has not progressed and therefore, the defacto complainant is before this Court seeking direction for expedite trial.

2. The learned counsel appearing for the petitioner would contend that the matter of case and case in counter, the counter case is pending trial in SC No.81 of 2021 before the same Judge, this Court has directed trial should be taken up on priority basis and completed within a period of five months, this order was passed on 04.06.2024.

3. The learned Government Advocate (Crl. Side) states that the case and case in counter, the Public Prosecutor in this case has been changed and new Public Prosecutor yet to take charge and once Public Prosecutor is appointed both this case in SC No.114 of 2021 and SC 2/4

No.81 of 2021 will be taken up for trial and necessary steps will be taken for speedy disposal.

4. Recording the said undertaking, the Criminal Original Petition is disposed of directing the respondent Police to marshal the witnesses on hearing dates and complete the trial as expeditiously as possible. 11.09.2024 Index : Yes/No : Yes/No jv To
