ORDER

The petitioner has lodged a complaint before the respondent police on 23.09.2020. Based on the complaint, First Information Report has been registered in Crime No.185 of 2023 for the offence under Sections 406 and 506(i) of IPC on 11.07.2023. Thereafter, no action has been taken and the petitioner is not aware of the status of the case. 2.The learned Government Advocate (Crl.Side) appearing for the respondent police on instructions submitted that in this case, investigation completed and after investigation, the case has been closed as 'mistake of fact' on 08.08.2023. RCS notice has been served to the petitioner/defacto complainant on 27.10.2023, but the RCS notice yet to be submitted along with the MF Report before the trial Court. Therefore, the learned Government Advocate (crl.side) seeks 15 days time to file the report.

3. In view of the above submissions, the respondent police is directed to file RCS notice along with MF Report before the trial Court 2/4

within a period of 15 days from the date of receipt of a copy of this order and on filing the report, the respondent police is also directed to inform the same to the petitioner. If the petitioner is aggrieved by the same, it is left open to the petitioner to workout his remedy in the manner known to law.

4. With the above directions, this Criminal Original Petition is disposed of.
