2/6 PRAYER This writ petition has been filed for issue of writ of mandamus directing the respondent directing the respondents herein to consider the representations of the petitioner dated 26.05.2025 and 23.06.2025 and fix the annual lease amount in respect of Kupanatham Dam, Thiruvannmalai District by following the orders of this Court dated 21.06.2023 made in W.P.No.6819 of 2023 etc., batch cases and extend the lease period from 01.07.2025 for a period of one year to the petitioner society.

ORDER

This writ petition has been filed for issue of writ of mandamus directing the respondents to consider the representations made by the petitioner on 26.05.2025 and 23.06.2025 and to fix the annual lease amount in respect of Kupanatham Dam, Thiruvannmalai District by following the orders passed by this Court in W.P.No.6819 of 2023 etc., batch cases dated 21.06.2023 and extend the lease period from 01.07.2025 for a period of one year.

3/6 2.Heard Mr.S.Senthilnathan, learned counsel appearing on behalf of the petitioner and Mr.E.Veda Bagath Sing, learned Special Government Pleader appearing on behalf of respondents 1 to 5.

3.This Court passed an order in W.P.No.28577 of 2024 dated 28.09.024, where a direction was given to respondents to deal with the representation and to take steps to auction the fishing lease rights. Pursuant to the said order, the auction was conducted and the concerned Society was given the lease through proceeding dated 10.02.2025 till the end of June 2025. 4.The grievance of the petitioner is that the lease ought to have been given atleast for a period of one year and whereas, the Society was able to have the advantage of lease only from 10.02.2025 to 30.06.2025. Therefore, the petitioner wants the lease period to be extended for a period of one year from 01.07.2025.

4/6 5.In the considered view of this Court, the concerned Society while participating in the auction was aware of the fact that the period of lease is only upto 30.06.2025. Therefore, no positive directions can be issued by this Court. However, it is left open to the petitioner to persuade the respondents through his representations which have already been made and it is left open to the respondents to take a decision.
