The petitioners, who were arrested and remanded to judicial custody on 19.04.2022 for the offences punishable under Sections 147, 148, 341, 323, 324 and 307 IPC and Sections 8(C) read with 22(c) & 29(i) of NDPS Act, in Crime No.310 of 2022, seek bail.

2. The case of the prosecution is that the petitioners along with other accused persons were found in possession of 25 tablet labeled as MDMA Ecstasy totally weighing about 13.5 grams. Hence, the case,

3. The learned counsel for the petitioners submitted that the petitioners are innocent persons and a false case have been lodged against the petitioners. Hence, he prayed for grant of bail to the petitioners.

4. The learned Government Advocate (Crl.Side) appearing for

the respondent submitted that there are totally 10 accused and the petitioners were in possession of 25 numbers of MDMA Ecstasy tablets weighing 13.5 gms. It is a commercial quantity. He further submitted that the petitioners attacked the de-facto complainant with knife and brandy bottles. Hence, he vehemently opposed for grant of bail to the petitioners.

5. Consider the above facts and circumstances of the case and the petitioners have failed to fulfil the twin conditions contemplated under Section 37 of the NDPS Act, 1985 and also now there is no change in circumstances of this case, this Court is not inclined to grant bail to the petitioners.
