The petitioner, who was arrested and remanded to judicial custody on 19.08.2022 for the offences punishable under Sections 4(1-A) and 4(1)(a) of TNP Act, in Crime No.352 of 2022, on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner was found in transportation of 28 bottles of TASMAC liquor. Hence the complaint.
3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays for grant of bail to the petitioner.
4. The learned Government Advocate (Crl. Side) appearing for the respondent would submit that this is the second application for bail before this Court. He would also submit that the petitioner was found in transportation of 28 bottles of TASMAC liquor. He would further submit 1/3
that there are 7 previous cases of similar nature as against him. Therefore, he vehemently opposed to grant bail to the petitioner.
5. Heard both the learned Counsel and perused the materials available on record.
6. Taking into consideration the facts and circumstances of the case, the submissions made by the learned counsel and also the petitioner has got 7 previous cases as against him and also taking note of the fact that very recently this Court had dismissed the application for bail in Crl.O.P.No.21775 of 2022 on 13.09.2022, this Court is not inclined to grant bail to the petitioner.
7. Accordingly, this Criminal Original Petition stands dismissed for the present.
