Learned counsel for the petitioner would submit that the accused had not denied the issuance of the cheque and the signature found on it. The accused had also replied to the legal notice issued by the petitioner whereas the trial court on erroneous finding in respect of the statutory presumption under the Act, had acquitted the accused. Prima facie case has been made out.

Leave is granted.
