The petitioner, who was arrested and remanded to judicial custody on 12.11.2024, for the offence punishable under Sections 8(c), 20(b)(ii)(C), 29(1), 25 of Narcotic Drugs and Psychotropic Substances Act, 1985 in Cr.No.304 of 2024, on the file of the respondent, seeks bail. 1/4

2. The petitioner herein along with the other accused found in possession of 40 kgs of ganja carrying in a Tata Nano car. Hence, he was arrested on 12.11.2024 by the respondent police. The present petition is filed for seeking bail.

3. Today, there is no representation on behalf of the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and opposed for grant of bail to the petitioner on the ground that the petitioner found in possession of commercial quantity of ganja. All the accused are belong to other States. If the petitioner is granted bail, there is every possibility of absconding. He further submitted that this petitioner is having one previous case of similar nature and therefore recurrence of crime also cannot be ruled out.

5. Considering the fact that the seized contraband is of commercial quantity and there is reasonable belief to hold that this petitioner had concious possession of the contraband which was transported in the car in which the petitioner was one of the co-passengers, this Court is not inclined 2/4

to grant bail to the petitioner. Hence, this Criminal Original Petition for bail stands dismissed.
