ORDER
This writ petition is filed to direct the transfer of the pending investigation from the file of the fifth respondent in C.S.R.No. 126 of 2025 dated 16.04.2025 to any other appropriate authority.
2. When the matter came up for admission, the learned Government Advocate (Crl. Side) appearing for the respondents would submit that, dehors the C.S.R. that is pending on the file of the respondent, a complaint was given to the file of the second respondent, namely, the Director, Directorate of Vigilance and Anti-Corruption, Chennai, which is forwarded to the Registrar of Co-operative Societies, Chennai and the Chairman-cum-Managing Director, Tamil Nadu Civil Supplies Corporation, to ascertain the basic facts. Once the preliminary report relating to the facts is received, depending on the outcome, further preliminary enquiry will be conducted and if any offence is made out, a case will be registered. Therefore, the said submission is recorded. 2/5
3. In view thereof, the prayer directing the transfer of investigation in C.S.R No. 126 of 2025 does not arise. The second respondent, through the appropriate officer, is directed to complete the preliminary enquiry and take a decision and if any offence is made out, register a case and investigate into the matter. The preliminary enquiry of collecting the information from the respective department and thereafter enquiring for themselves as to the facts shall be completed within a period of three months from the date of receipt of the web copy of the order without waiting for the certified copy of the order. After the receipt of the report and after their preliminary enquiry, if any prima facie case is made out, then necessary action will be taken. No costs. 24.07.2025 nsl 3/5
