This application has been filed to appoint an Advocate commissioner to record the first applicant's/first plaintiff's evidence in the above suit.

Heard the learned counsel for the applicants and the learned counsel for the respondents.

Learned counsel for the respondents have no objection in allowing the application.

Considering the averments made in the affidavit filed in support of the application and the no objection expressed by the learned counsel for the respondents, this application is ordered. 5.

This Court is of the view that it would be appropriate to appoint Advocate Commissioner to record the evidence of PW.1. Therefore, Mr.A.Chandrasekar, Advocate, No.126, Vision Center Building, 3rd Floor, Broadway Road, Chennai - 600 108 (Mob.No.9840663438/7395997254) is appointed as Advocate Commissioner, for the purpose of recording the evidence of P.W.1 http://www.judis.nic.in 1/2

at Celvin Manor, Cheral Beach Road, South Vypen Island, Cochin - 683 514. The initial remuneration of the Advocate Commissioner is fixed at Rs.50,000/- which shall be payable by the applicant, within one week from the date of receipt of a copy of this order. 6.

Further, this Court directs the plaintiff to file a proof affidavit with the Advocate Commissioner on or before 09.09.2019. Thereafter, the defendants shall cross examine on 16.09.2019 and the same shall be completed on or before 27.09.2019. 7.

Advocate Commissioner shall file a report before this Court on 16.10.2019.
