Crl.O.P.No.27553 of 2016 R.MALA,J.

The petitioner apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 342,323,365 and 506(i) IPC in Crime No.1216 of 2016 on the file of the respondent police and hence, prays for anticipatory bail.

2. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that the earlier anticipatory bail application filed by the petitioner was dismissed by this Court on 16.11.2016. Investigation is considerably over and hence, he prays for anticipatory bail.

The learned Government Advocate (crl.side) would submit that the petitioner was arrayed as A2 and his earlier anticipatory bail petition was dismissed on 16.11.2016 on the ground that his personal interrogation is necessary. He would further submit that the injured has been discharged from the hospital. However, he prays for dismissal of the application.

4. Considering the rival submissions made by both sides and also considering the fact that the injured has been discharged from the hospital and even though the petitioner was not arrested, neither he interfered with the investigation nor absconded from the R.MALA,J.,

nvi jurisdiction, I am inclined to grant anticipatory bail to the petitioner, with certain conditions.

Accordingly, the petitioner is ordered to be released on bail in the event of his arrest or on his appearance before the learned XXIII Metropolitan Magistrate, Saidapet, Chennai and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that: (i) the petitioner shall report before the respondent police for interrogation on receipt of summons;

(ii) the petitioner shall report before the Court concerned daily at 10.30 a.m. until further orders.
