ORDER

This writ petition has been filed for the issue of writ of Mandamus directing the respondents to consider the representation made by the petitioner on 13.02.2025 wherein the petitioner is seeking for appointment of Kazi from the Dakni Muslim community.

Heard Mr.R.Rajarajan, for Mr.S.Keran, learned counsel for the petitioner and Mr.P.Ganesan, learned Additional Government Pleader for Respondents 1 and 2.

The case of the petitioner is that traditionally Kazi was selected from the Dakni Muslim community. As per Section 2 of the Kazi Act, 1880 wherever it appears to the State Government that any considerable number of Muhammadans resident in any local area desire that one or more Kazis should be appointed for such local area, the State Government can take a decision in this regard after consulting the principal Muhammadan residents of such local

area and select more than one person and appoint them as Kazi for such local area. In view of the same, a representation dated 13.02.2025 was given by the petitioner for appointment of two kazis. Since the same was not considered, the present writ petition has been filed before this Court. 4.

The learned Government Advocate appearing on behalf of the respondent produced the copy of GO (D) No.65 dated 11.07.2025 wherein one person has been appointed as a Kazi under Section 2 of the Kazi Act, 1880. He has been given a period of three years to hold the post of District Kazi from the date of issuance of the order.

The learned counsel for the petitioner submitted that the petitioner does not have any objection for the appointment of Kazhi and the request made by the petitioner is to appoint more than one Kazhi from the Dakni Muslim Community and the same has not even been considered by the Government and therefore, the petitioner is requesting the Government to take a decision on the representation made.

Taking into consideration the facts and circumstances of the case and the stand that has been taken by the petitioner, there shall be a direction to the 1 st respondent to deal with the representation dated 13.02.2025 and to convey the decision to the petitioner within a period of six weeks from the date of receipt of a copy of this order.

This writ petition is disposed of with the above directions. No costs.
