IN THE HIGH COURT OF JUDICATURE AT MADRAS
DATED : 29.07.2025
CORAM
THE HONOURABLE MR. JUSTICE P.B.BALAJI Mr.Vikram Srikanth.B ... Petitioner Vs.
Mr.S.Srisubhashini ... Respondent Prayer: Civil Revision Petition filed under Article 227 of the Constitution of India, pleased to issue direction to the learned Principal Family Judge,Coimbatore to dispose of the HMOP.No.835 of 2022 pending on the file of learned Principal Family Judge,Coimbatore. For Petitioner : Mr.I.Calvin Jones
ORDER
The husband in the matrimonial proceedings pending before the Principal Family Judge, Coimbatore is the revision petitioner. The petitioner seeks expeditious disposal of HMOP.No.835 of 2022 pending on the file of learned Principal Family Judge,Coimbatore.
2. In view of the limited prayer sought for in the revision, notice to respondent is dispensed with.
3. The learned counsel for the petitioner took me through the typed
set of papers and various orders passed by this Court requiring the proceedings to be expedited. I find that the case was originally filed before the Principal Family Court, Bangalore and pursuant to the orders of the Hon'ble Supreme Court, the same was transferred to the file of the Principal Family Court, Coimbatore.
4. The petitioner had earlier moved this Court by way of CRP.No.1861 of 2023 seeking earlier disposal. The said revision came to be allowed on 21.06.2023 directing the Family Court, Coimbatore to dispose of the HMOP.No.835 of 2022 within a period of six months. However, it is seen that as on date the original petition has not been disposed of. It is also brought to the notice of this Court by the learned counsel that orders were reserved as early as 06.02.2025.
5. In the light of the above, it would suffice to allow the revision petition directing the learned Principal Family Judge, Coimbatore to pass final orders in HMOP.No.835 of 2022 on merits and in accordance with law within a period of eight weeks from the date of receipt of copy of this order.
6. Accordingly, the Civil Revision Petition stands allowed. No costs.
