Prayer: This Criminal Appeal is filed under Section 415(2) of BNSS, 2023 praying to set aside the conviction and sentence passed by the learned Sessions Judge, Magalir Needhimandram (Fast Track Mahila Court), Villupuram vide S.C.No.118 of 2019 dated 28.02.2025 and acquit the appellant from the charges.

ADVANCE ORDER This Criminal Appeal is allowed and the Judgment dated 28.02.2025 in S.C.No.118 of 2019 passed by the learned Sessions Judge, Magalir Needhimandram (Fast Track Mahila Court), Villupuram is set aside. The Appellant/Accused is acquitted of all the charges under Sections 417 & 376 of I.P.C.
2. It is reported by the learned counsel on either side that the Appellant/Accused is now in incarceration.
3. The Appellant/Accused is directed to be set at liberty forthwith unless his custody is otherwise required in connection with any other case. Fine amount, if any paid, shall be refunded to the Appellant/Accused forthwith. Bail bond, if any executed, shall stand cancelled.
