ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

2. The present writ petition is filed praying for a writ of Mandamus to 1/4

direct the respondent to survey and fix the boundaries of the property in S.Nos.55/4, 63/1A and 63/4A, in Kaniyamoor Village, Kallakurichi Taluk, Kallakurichi District by considering the application dated 03.08.2020 and representation dated 16.06.2025.

3. It is the case of the petitioner that he submitted an application seeking survey of subject property on 03.08.2020 and has also paid the appropriate fees, however, the same was not considered. Petitioner thereafter submitted a representation on 16.06.2025 to the respondents seeking survey, which is stated to be kept pending. Aggrieved, the petitioner has approached this Court.

At the outset, it is submitted by Mr.S.Jayachandran, learned Government Advocate for respondent that the above application submitted by the petitioner would be considered and appropriate orders would be passed within a time frame to be fixed by this Court. Agreed to by the learned counsel for petitioner.

5. In considering the representation dated 16.06.2025, it is open to the respondents to call for any documents/ evidence to satisfy itself of petitioner's entitlement to seek survey of subject property and proceed to pass appropriate 2/4

orders in accordance with law, after putting the petitioner on notice and after affording reasonable opportunity of hearing to the petitioner and any other interested persons/stake holders, including rival claimants, if any, within a period of 8 weeks from the date of uploading of web copy without waiting for receipt of certified copy. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the case on its own merits and in accordance with law.
