PRAYER:Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus or order or Direction or any other appropriate Writ in the nature of Mandamus by directing the Respondents 1 to 5 herein to consider the representation made by the petitioner on 25.07.2022 for reallotment of the Survey No.1014/2 situated at Krishnagiri District as Adi Dravidar Condition Land.

ORDER

The present petition has been filed seeking a direction to respondents 1 to 5 to the consider the petitioner's representation dated 25.07.2022 requesting for reallotment of the Survey No.1014/2 situated at Krishnagiri District as Adi Dravidar Condition Land.

2. It is the case of the petitioner that Government had allotted the subject property to the petitioner's grand father namely Putta Yellappa under a scheme of Adi Dravidar Condition land, for which patta was issued in favour of him. The said property was alleged to have been illegally registered in favour of one Muniappa who is the son-in-law of the 2/6

petitioner's grandfather and a fake sale seed has been created in his favour, based on which, the said property had been alienated in favour of the third party. On coming to know the aforesaid, the petitioner made a representation to the official respondents on 25.07.2022 requesting to cancel the above said fake sale deed. However, till date, no action has been taken on the said representation. Hence, the present petition has been filed.

Though very many grounds have been raised, learned counsel for the petitioner submits that, it would suffice, if this Court issues a direction to the respondents to consider the representation dated 25.07.2022 made by the petitioner and pass orders on the same, within the time that may be stipulated by this Court.

4. Learned Additional Government Pleader appearing for the respondents 1 to 5 the petitioner's representation will be considered within the time that may be stipulated by this Court. 3/6

In view of the aforesaid submissions, this Court without going into the merits of the case, directs the 3rd respondent/District Revenue Officer to consider the representation dated 25.07.2022 made by the petitioner and pass appropriate orders on the same in accordance with law, after affording sufficient opportunity of personal hearing to the aggrieved persons if any, within a period of twelve weeks from the date of receipt of a copy of this order.

6. Accordingly, this Writ Petition is disposed with the aforesaid direction. No Costs.
