Respondents Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the 1st respondent to conduct enquiry on the petitioner's representation dated 09.09.2016 as enunciated under Section 10 of the Passport Act, 1967 and such other relevant provisions in connection with the issuance and continuance of Indian Passport No.Z3737398 to the 4th respondent.

ORDER

This Writ Petition has been filed for issuance of a Writ of Mandamus directing the 1st respondent to conduct enquiry on the petitioner's representation dated 09.09.2016 as enunciated under

Section 10 of the Passport Act, 1967 and such other relevant provisions in connection with the issuance and continuance of Indian Passport No.Z3737398 to the 4th respondent.

2. When the petition is taken up for hearing, there is no representation for the petitioner. Heard the learned counsel appearing for the respondents 1 to 3.

3. The learned counsel for the respondents 1 and 2 filed a counter and in the said counter in Paragraph No.6, the authority has clearly stated that the letter dated 14.09.2016 was sent to petitioner to submit the copies of the documents against the 1st respondent, which attracts relevant provision of Indian Passports Act, 1967 and if the petitioner submits the same, necessary action would be initiated against the 4th respondent in accordance with the Indian Passports Act, 1967.

4. In view of the Paragraph No.6 found mentioned in the counter affidavit filed by the respondents 1 and 2, this Writ Petition is closed. The Writ Petitioner is always at liberty to produce the documents and thereafter, the respondents 1 and 2 are directed to consider the same in accordance with law. Consequently connected miscellaneous petition is closed. No costs.
