PRAYER: First Appeal filed under Section 96 of the Civil Procedure Code against the Judgment and decree dated 23.06.2023 made in O.S.No.36 of 2018 on the file of the IV Additional District and Sessions Court, Tiruvallur at Ponneri.

J U D G M E N T

Today, a joint memo of compromise has been filed. It is seen that the parties have negotiated and settled their dispute and the appellant who is the defendant has paid a sum of Rs.45,00,000/-

(Rupees Forty Five Lakhs only) to the respondents/plaintiffs towards the cancellation of the sale agreement. It is also seen that the respondents/plaintiffs have deposited a sum of Rs.10,00,000/- (Rupees Ten Lakhs only) towards the balance sale consideration which the parties agreed could be withdrawn by the respondents/plaintiffs.

This memo of compromise is taken on file. Accordingly, this first appeal is decreed in terms of the Memorandum of Compromise dated 27.11.2023. The terms of Memorandum of Compromise dated 27.11.2023 signed by the plaintiffs and the defendant shall form part and parcel of this judgment and decree. No costs.

The learned counsel for the appellant has not signed in the memo of compromise but the appellant is present in person before this Court and the appellant's identity has been verified with the Aadhar Card produced by him.

The learned counsel for the respondents would submit that they would be cancelling the agreement of sale within two weeks from today.

Therefore, recording the same, the above first appeal is decreed in terms of memo of compromise. Connected C.M.P. stands closed. No costs. The Registry is directed to refund the Court fees as per the procedure.
