4.Mr.P.Suresh Srinivasan, learned counsel undertakes to file vakalat for the 3 rd respondent and he has got objections in allowing the petition.

5.Being satisfied with the reasons stated in the affidavit filed in support of this petition, this Civil Miscellaneous Petition is ordered and the delay of 120 days is hereby condoned.
