Since both the petitions have been filed by the petitioner herein, a common order is passed.

W.M.P.No.24157 of 2023 had been filed to implead the Government of Tamil Nadu, Represented by its Principal Secretary to Government, Health and Family Welfare Department, Secretariat, Chennai - 600 009 as further respondent in the writ petition. 2.1 In the affidavit filed in support of the petition, it had been stated that the age limit fixed for Backward Community to apply for the post of Driver is 32 years, whereas the age of the petitioner when the impugned notification was published is 38 years. It is only the respondent, who is now sought to be impleaded who can grant relaxation of the age. In view of that particular fact, this petition is allowed.

In the affidavit filed in support of W.M.P.No.24165 of 2023 it had been stated that originally the writ petition had been filed questioning the Notification relating to recruitment of Drivers in the Primary Health Centers, including the second respondent. https://www.mhc.tn.gov.in/judis

ssm 3.1 Now, the amendment is sought to the prayer questioning the Notification issued for recruitment of Drivers for the respondent / Primary Health Center, specifically and also for grant of age relaxation since the petitioner had been working in the second respondent Primary Health Center from 04.02.2005 and to appoint the petitioner as Driver in the second respondent / Primary Health center.
3.2 Since there is no shift in the material facts, and it is continuation of the earlier relief sought, this relief for amendment is allowed.

Registry is directed to carry out necessary amendments in the cause-title by impleading the newly impleaded respondent, as stated in W.M.P.No.24157 of 2023 as the second respondent and re-arrange the position of respondent nos. 2 and 3 as respondent nos. 3 and 4.
