ORDER

Representation given by the petitioner to the respondents police alleging that the third and fourth respondents are preventing him from digging bore well and putting up construction in the land owned by him, has not been considered by the respondents police and hence, the present petition is filed seeking direction to act on the representation given by the petitioner.

2. The third and fourth respondents on receipt of the notice they have not engaged any counsel or appear in person before this Court.

3. The learned Government Advocate (Crl.Side) appearing for the respondents 1 and 2 submitted that he obtained prior permission from the authority for digging bore well and putting up construction. The 2/5

private respondents 3 and 4 have no authority to prevent the said legal activity and therefore, he seeks police protection to put up bore well in the property.

4. This Court, on perusing the representation of the petitioner and the title documents as well as the payment of requisite fee for digging bore well, satisfied that the petitioner's peaceful enjoyment of the property cannot be prevented by the third parties particularly, the respondents 3 and 4. Hence, the 2nd respondent police is directed to provide police protection when the petitioner engages men and material for digging bore well in the said property.

5. With the above observation, this Writ Petition is disposed of. No costs.
