These petitions have been filed to substitute the legal heirs of the deceased 7th respondent as the proposed respondents 11 to 14, to set aside the abatement and to condone the delay of 423 days in setting aside the abatement.

2. Heard the learned counsel for the petitioner. Despite serving notice on the proposed respondents 11 to 14 and their names having been printed in the cause list, there is no representation on behalf of them.

3. However, having regard to the reasons stated in the affidavit filed in support of these petitions and being satisfied with the same, these Civil Miscellaneous Petitions are ordered as prayed for.

4. The Registry is directed to carry out the necessary amendments in A.S. No.476 of 2011 and list the matter on 08.01.2024. Issue notice to the impleaded respondents 11 to 14, returnable by 08.01.2024.

5. Post the matter on 08.01.2024.
