This application has been filed seeking to condone the delay of 1531 days in filing the written statement of defendant in the above suit.

2. Though counter is filed, the first defendant was already permitted to file written statement by paying the cost of Rs.10,000/-, said cost is also paid. Therefore, this Court is inclined to condone the delay in filing the written statement in the above suit and the said written statement is taken on record.

Accordingly, this application is allowed.

4. The Registry is directed to post the main suit on 11.01.2024 for framing issues.
