This application has been filed to set aside the ex-parte decree and judgment dated 17.07.2023 passed in C.S.No.182 of 2019 for non filing of written statement and also prayed to condone the delay of 1531 days in filing the written statement in the suit.

2. Now, it is seen that written statement has been filed and taking into account, the suit is of civil in nature, this Court considering the conduct of the applicant, is inclined to set aside the ex-parte order on some terms.

Accordingly, the ex-parte order dated 17.07.2023 is set-aside subject to payment of cost of Rs.10,000/- (Rupees Ten Thousand Only) to the Madras Advocate Clerks Welfare Association, High Court Campus, Chennai, on or before 24.11.2023.

3. Post this matter on 24.11.2023.
