C.M.P.No.17058 of 2025 is filed to condone the delay of 735 days in filing the petition to set aside the abatement caused due to the death of the 2nd respondent/Ramakrishnan in the above Cross Objection and Civil Miscellaneous Appeal.
(ii)C.M.P.No.17059 of 2025 is filed to set aside the abatement caused due to the death of 2nd respondent/Ramakrishnan in the above Cross Objection and Civil Miscellaneous Appeal. (iii)C.M.P.No.17061 of 2025 is filed to bring on record the respondents 2 to 4 as legal representative of the deceased/2nd respondent viz., Ramakrishnan in the above Cross Objection and array them as respondents 3 to 5 in Cross Objection No.2 of 2024 in C.M.A.No.1770 of 2023.

4.Learned counsel for the first respondent has no serious objection in allowing these petitions.
5.Being satisfied with the reasons stated in the affidavits filed in support of these petitions, the petitions are ordered. Accordingly, the delay is condoned and interest for the delay period is ordered to be waived.
6.Issue notice to the newly added respondents returnable on 09.09.2025.
7.Registry is directed to carryout necessary amendment in Cross Objection as well as Civil Miscellaneous Appeal and list the matter on 09.09.2025.
