This Civil Miscellaneous Petition has been filed seeking to condone the delay of 29 days in filing the above Civil Miscellaneous Appeal against the order dated 10.04.2024 passed in MCOP.No.258 of 2021 on the file of Motor Accident Claims Tribunal, Tindivanam.

2. Mrs.R.Sree Vidhya, learned counsel for appellant submitted that since the papers were mixed up with other settlement files, the appellant is not able to file the appeal within a stipulated time and after due search, it was traced out and thereafter, getting sanction from the competent authorities, the appeal was filed on 13.08.2024, as a result of which, there is a delay of 29 days in filing the above Civil Miscellaneous Appeal arose, which is neither willful nor wanton. Therefore, she filed this petition to condone the delay in filing the above Civil Miscellaneous Appeal.

3. Considering the facts and circumstances, and the reasons stated by the petitioner in the affidavit is justifiable one. Accordingly, this court is inclined to allow this petition.
