Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the learned Judicial Magistrate No.I, Krishnagiri to conduct speedy trial in the above case in CC.No.138 of 2014 on his file and complete the trial of the case within the time stipulated by this Court. ORDER

This criminal original petition has been filed by the petitioner seeking for fixing time limit for completion of trial in CC.No.138 of 2014 on the file of the Page No.1/4

learned Judicial Magistrate No.I, Krishnagiri.

2. Heard the learned counsel for the petitioner and the respondent and also perused the materials available on record.

3. The learned Additional Public Prosecutor submitted that there are totally 7 accused persons in this case and except the petitioner, all the other accused persons, A2 to A7 are absconding and non-bailable warrant is pending against them.

4. In the considered view of this Court, this calender case is of the year 2014 and it cannot be kept pending endlessly just because the other accused persons are absconding and yet to be secured. In view of the same, if the Court below is satisfied that the other accused persons cannot be secured within a reasonable time, it is left open to the Court below to split up the case and proceed with the trial insofar as the petitioner is concerned and the same shall be completed within a period of 3 months from the date of receipt of copy of this order. In the meantime, the respondent-police shall take all the efforts to secure the accused persons A2 to A7 and produce them before that trial Court. Page No.2/4
