quash the same and to consequently forbear the respondent from reopening the enquiry/re-verification pertaining to the community certificate of the petitioner as it has already verified by the District Collector, Chennai, order dated 31.07.1995 and in the light of the judgment of the Hon'ble Supreme Court made in J.Chitra v. District Collector and Chairman, State Level Vigilance Committee, Tamil Nadu and others (C.A.No.5160 of 2010 dated 21.09.2021) reported in (2021) 9 SCC 811.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) Heard learned counsel for the parties.

2. Challenge to the impugned letter must fail on the short ground that this petition is not maintainable, as notices have been issued and enquiry has been undertaken pursuant to the order passed by this Court on 21.04.2025 in the petition [WP.No.27907 of 2023] filed by the petitioner himself. In the said case, after hearing the

parties, the following order was passed:

"8. That being so, the petitioner is at liberty to defend his case. The State Level Scrutiny Committee is requested to complete the enquiry and pass appropriate orders within a period of three months from the date of receipt of a copy of this order. The petitioner is directed to co-operate, and in the absence of any co-operation, the Committee shall proceed by recording his non-cooperation in the proceedings itself."

3. In that view of the matter, the present petition is liable to be dismissed. Accordingly, this petition is dismissed. However, this order shall not come in the way of the petitioner in the matter of challenge to the legality and validity of the order dated 21.04.2025 in such proceedings, as may be taken recourse to in law. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
