O R D E R
The petition has been filed to direct the first respondent to transfer the case in Crime No.140 of 2024 on the file of Thazhampur Police Station, Chengalpattu, to CBCID.
2. This Court when the matter came up for consideration after going through the records found flaw in the investigation and therefore, directed the Commissioner of Police, Tambaram to file Status Report regarding the investigation and file the same within a period of two weeks.
3. Today when the matter came up for hearing, the learned Government Advocate (Crl. Side) filed a status report of the Commissioner of Police, Tambaram, wherein it is stated that after noticing improper investigation in the case, the case has been entrusted to 2/5
Assistant Commissioner, Kelambakkam Range, for investigation and also action taken against the earlier I.O. for dereliction of duty. Subsequent to the change of investigation officer seven persons have been arrested, the charge has been altered to Section 306 of IPC as well as 2800 Tydol ablets seized have been sent for analysis and based on the analysis report necessary charge will be altered.
4. In the status report it is also stated that charges have been altered to 34, 120(b), 201 and 302 IPC and the RDO enquiry has also been initiated and would submit that on completion of investigation, final report will be filed in due course.
5. Taking note of the action taken by the Assistant Commissioner, pursuant to the order passed by this Court on 20.08.2024, the Criminal Original Petition is disposed of with direction to the I.O. to complete the investigation as early as possible and file a final report under appropriate provision of law.
