CMP.No.5495 of 2022 in S.A.No.997 of 2013 SATHI KUMAR SUKUMARA KURUP, J., This Civil Miscellaneous Petition has been filed to set aside the abatement caused due to the death of deceased 1st Appellant in this Second Appeal.

2. The learned Counsel for the Appellant submitted that the legal heirs of the deceased was not aware of the proceedings.

3. Even though the learned Counsel for the Respondent filed counter objecting the delay as well as abatement, on being satisfied with the reasons stated in the affidavit filed by the Petitioner, this Petition is allowed.
