ORDER

(made by N.SENTHILKUMAR, J.) The present civil miscellaneous petition is filed by the State to condone the delay of 232 days in filing a writ appeal against the order of the learned single Judge dated 23.07.2024 passed in W.P. No.3696 of 2023.

2. In the affidavit filed in support of the petition, the appellants had narrated the facts and the grounds raised in the main writ appeal and the same have been replicated in the condone delay petition. The appellants have not

averred even a single statement in the condone delay petition to justify the reasons which caused the delay. The only paragraph, which deals with the condonation of delay in the affidavit filed by the appellants, is extracted hereunder:

"12. It is submitted that a delay of 232 days had occurred in preferring the present appeal against the impugned judgment. The said delay is neither wilful nor wanton and only due to bona fide reasons. No prejudice would be caused to the respondents if the said delay is condoned."

3. Except for the above, the appellants have not given any other reason for the delay. In the absence of any valid reason for the delay, it is inappropriate to condone the delay merely for the reason that an application has been filed for condonation of delay and hence we are not inclined to condone the delay.

4. Accordingly, this petition is dismissed. No costs. The Registry is directed to return the appeal papers to the appellants. [A.S.M., J] [N.S., J] Asr 26.08.2025 Index:Yes/No Speaking order/Non-speaking order
