ORDER
Heard Mr.G.Punniyakotti, learned counsel for the petitioner and Mr.V.S.Ramesh, learned Government Advocate, accepting notice on behalf of the respondents and with the consent on either side, the writ petition is taken up for final disposal. The petitioner has filed the present writ petition seeking for a direction to the respondents to release the Tipper Lorry bearing Registration No.TN-10-T-2365 which was seized by the 2nd respondent on 14.07.2016, by considering his representation dated 17.08.2016.
The petitioner would state that he is the owner of the Tipper Lorry bearing Registration No.TN-10-T-2365, which was seized by the 2nd respondent on 14.07.2016 on the allegation of transportation of sand illegally. The petitioner, in this https://hcservices.ecourts.gov.in/hcservices/
regard, has submitted a representation dated 17.08.2016 to the respondents for the release of the vehicle and since he has not been favoured with any kind of response, he came forward to file the present writ petition.
The learned Government Advocate would submit that there is no proof available for service of such representation to the respondents.
In the light of the above, this Court, without going into the merits of the case, permits the petitioner to submit a fresh representation along with a copy of this order as well as a copy of his earlier representation dated 17.08.2016 to the respondents within a period of one week from the date of receipt of a copy of this order and on receipt of such representation, the respondents are directed to consider the same on merits and in accordance with law, within a further period of two weeks thereafter and communicate the decision taken, to the petitioner.
The writ petition is disposed of with the above direction. No costs.
