O R D E R
This petition has been filed seeking modification of one of the conditions imposed on the petitioner by the IV Additional District Sessions Judge (FAC), Coimbatore while allowing the bail petition in Crl.MP.No.1598 of 2021 dated 23.04.2021.
2. The learned counsel for the petitioner submits that the Court below while enlarging the petitioner on bail on 23.04.2021 in Crl.MP.No.1598 of 2021 had imposed certain conditions and one of such conditions was that the petitioner/accused No.3 has to execute the bond for Rs.1,00,000/- with two sureties and among them one should be his blood relation and further the petitioner/accused No.3 is directed to appear before the respondent police on daily at 10.00am., for first two weeks and https://hcservices.ecourts.gov.in/hcservices/
then one every Sunday until further orders.
3. The learned counsel for the petitioner further submits that the petitioner was not able to mobilize funds due to the pandemic situation and seeks for modification of the above said condition.
4.The learned Additional Public Prosecutor submits that he has no objection for modifying the said condition.
5. Taking into consideration the facts and circumstances of the case, the condition in Paragraph No.4 shall stand modified as follows:
" The petitioner/accused No.3 is directed to execute the bond for a sum of Rs.30,000/- instead of Rs.1,00,000/- with two sureties as stated by the Court below".
6. Except the above modification, the other conditions imposed by the Court below in Crl.MP.No.1598 of 2021 on 23.04.2021, shall remain unaltered.
7. With the above modification, this Criminal Original Petition is disposed of.
