c) Declaring that the elected office bearers of the year 2017 are only competent to file Form VII before the District Registrar Co-operatives, Central Chennai;

d) Mandatory injunction directing the 20th defendant to conduct a fresh election in terms of the bye laws including all the Member District Associations, Office bearers elected during the year 2016 by calling for a General Body Meeting in terms of the Bye Laws; e) Permanent injunction restraining the elected office bearers of TNGA viz., the defendants 1 to 16 from acting, representing, communicating with anyone as office bearers of TNGA;

f) Directing the defendants to pay the costs of this suit. JUDGMENT

The learned counsel appearing for the plaintiffs would submit that the election for the subsequent period has been conducted and new office bearers have been elected, hence nothing survives in the above suit and seeks 3/6

permission of this Court to withdraw the above suit. He would also seek to direct the Registry to refund the Court fees in the name of the 1st plaintiff.

2. The learned counsel for the plaintiffs had also filed a memo to that effect.

3. Accordingly, the suit in C.S.No.357 of 2021 is dismissed as withdrawn. However, there shall be no order as to costs.

4. Registry, High Court of Madras, is directed to grant necessary refund of Court fee in the name of the 1st plaintiff, as applicable. 18.08.2025 dsa 4/6
